Sounds like a bonafide visa problem to me.
Hereâs the thing. If he was going to work in the USA as a tenure track professor, shouldnât he have gone ahead and put in a green card packet?
Hell, my wife sponsored my Mother in lawâs green card packet from China during her six month visa stay; she was approved and has had a green card ever since.
My wife, incidentally, is a naturalized citizen.
Does your wife ever travel back to China?
When the visa is up itâs time to go home.
She hasnât since she became a citizen, but will likely have to after her Mom passes.
She still owns a condo there and will need to sell it at that point.
F-1 (student) visas are not eligible for green cards, and most employment visas require you to work for several years (6 if youâre on an H-1B) before applying for a green card.
My point isâŠwhy didnât UH help him to get a WORK visa instead of a student one, and at that point, if he planned to be on tenure trackâŠwhy didnât he put in a green card packet?
Why was he here on a student visa if he planned to work as a faculty member as opposed to being here as a student?
Seems that he didnât follow the right protocol.
Thatâs the common path. Use your student visa for the first few years and then get a company to sponsor you for an H1B. Literally everyone does it this way. You canât fault UH or the kid.
