Rumor went around earlier today that Briles was going to be suspended for a year and reinstated, here’s a good response from Dan Bernstein in Chicago:

Even the fact that it has gotten this far is an insult, regardless of whether the board can muster the votes. USA Today has reported that the faction behind the proposal is a “small minority” and “on the margins,” but that anyone at all in a position of influence at Baylor would want this is offensive.

The interim president said the conference call amongst the Baylor Board of Regents, scheduled for 6 p.m. Monday, wasn’t even set up to be about Briles.

“The meeting was scheduled before, and for a quite different issue,” he said.

At the very least, Baylor and Briles’ biggest supporters and detractors agree on one central principle: The 13-page “Findings of Fact” document released on May 26 isn’t detailed enough. It’s based on nearly nine months of research and interviews with 65 people in various departments around the university by the Pepper Hamilton law firm. Baylor’s failings in handling sexual violence allegations stretch beyond the football program and into university administration, but no coaches, players or university staff are explicitly mentioned by name within the 13 pages.

Baylor’s Interim President David Garland admitted he had been instructed not to speak with the media before having KCEN HD News thrown off campus on Tuesday.

KCEN HD News has been demanding transparency from Baylor University, urging the administration to release the findings of the Pepper Hamilton Report, which was the culmination of an investigation into how Baylor leadership handled reports of sexual assault involving members of the University community.

3 more women sue Baylor over reaction to rape allegations

The lawsuit alleges Baylor violated federal Title IX anti-gender discrimination regulations, and that Baylor’s failure to properly investigate and respond to their claims “furthered sexual harassment and a hostile environment, effectively denying plaintiffs, and other female students, access to educational opportunities.”

The lawsuit says the woman in the 2004 attack dropped out in 2008, then re-enrolled at Baylor in 2015 only to be suspended in 2016 when anxiety over media reports of the investigation into sexual assaults impacted her school work. The woman in the 2014 case said she dropped out after the fall 2015 semester.

The lawsuit doesn’t say whether the woman in the 2013 attack remains in school, but said it has “severely impaired her physical and mental health and well-being.”


Attorney John Clune of Boulder, Colorado, who represented the former Baylor women’s soccer player in her case against the school, told Outside the Lines last month that he could have as many as three additional victims who might file lawsuits against Baylor.

So much for Briles returning after today. Lot more news today and with Briles now suing the University, lot of details are going to come out that haven’t already. Don’t blame Briles really; he wants to clear up his name so he can go coach at another big time school. Doesn’t want to end up like Dave Bliss:

I asked him of all the criticisms that he has heard of Baylor throughout this saga that is nearly one year old, which one stung the worst.

He did not pause and said, “That we didn’t learn from [2003 and 2004].”

Maybe they did and the new leaders in charge simply forgot, or never learned. Whatever the case, they need to listen to Drayton McLane and get moving on this.

“Mr. Briles does not wish to settle the (lawsuit) and does not consent to any settlement in that case or any other case in which (Briles) is jointly named as a defendant and currently outstanding or filed in the future,” Briles’ attorney, Ernest Cannon, said.

A buyout between Briles and Baylor still the most likely outcome

While Briles and Baylor appear at odds, that could change suddenly if they’re able to reach a financial buyout that works for both sides. Any buyout would likely contain non-disclosure and non-disparagement language. This language would assign monetary damages in the event that Briles or Baylor publicly disparaged the other or shared confidential information. This language would likely also position Briles and Baylor to work together on resolving any remaining litigation. At the end of the day, a buyout likely makes sense for both sides. We’ll see if one materializes.

The school did not name the prospects in question in a news release, but several outlets reported they are defensive back Parrish Cobb, defensive back Donovan Duvernay, offensive lineman Patrick Hudson, running back Kameron Martin and offensive lineman J.P. Urquidez.
