Jim, how much needs to be done to be binding? I remember there was some agreement two oil companies had some years back (I think Texaco and Pennzoil) that only had a handshake. One of them wanted to back out, but if I recall correctly, the handshake held up in federal court. Being the law expert you are, maybe you remember this, and maybe you would know if I am not remembering correctly. It was about 30 or 40 years ago, so I may be completely missing on the whole deal.
Bottom line here is - Mack and Baylor’s admin conned us.
They called us and said some things, blew some smoke up our rear, and got some good press announcing a phantom football game they knew they could call off and blame on coronavirus. And that it cost us thousands in logistics and a week of practice, unintentional red meat for Baylor fans.
And that home and home is straight BS. Words written in water.
I hope Pezman takes a lesson from this and is more careful dealing with the Big 12 in the future.
FWIW, the responses on SicEm365 Baylor fan forum are practically 100% backing Dana. Those Bear fans completely understand Dana’s sentiment and feel that Mack should just keep his mouth shut. They also want a Home and Home, but are worried now that it is in danger of not happening. I don’t get the feeling that Rhoades is liked very well over there.
Yep, their fans are cool about it. Lets not blame “Baylor” for the behavior of one administrator.

There is a lot of hard feelings there for Rhodes since he outsourced the tailgating process to an outside company. Costs for spots and items such as tents, etc. went way up. Set-up access became an issue as well. Now I’m hearing there are issues for tailgaters getting refunds for this year. They had a very good system before and his greed for a small amount of additional revenue (in comparison to overall income) has really ruffled some feathers.

Mike: You remember the Pennzoil v Texaco case right. Joe Jamail got the highest civil verdict in history on the basis of a handshake agreement. There was evidence of substantial loss. Damages. I haven’t thought through nor do I have the factual basis to know what damages we might be able to prove if Baylor refuses to live up to its agreement.

Bingo! This is exactly what I think. It seems to me at least that someone got to Mack and told him to find a reason to call this off. Baylor could have played and given the time, trouble and effort to get this game together should have found a way. They were short one offensive lineman they could have sat for suspension at another game. If we ever play Baylor in football anywhere I will be extremely surprised.
