I’m telling you the JUDGE’S comments are politely telling FSU they are grasping at straws.
But hey…FSU is a good customer for the legal system, they are allowing lawyers/judges to make millions so they’ll keep this going!

multiple reporters, includung McMurphy, have publicly stated the B1G & SEC have zero interest in adding FSU + Clemson as they do NOT bring value. The SEC commissioner even echoed this during SEC media days
the ACC starts this season with three NEW expansion schools in NEW states generating MORE revenue for the conference

yep…just give them enough hope to keep on raking in the $$ for the lawyers, judges, and courts.
Would be dumb to turn away a foolish emotional customer willing to pay $$$ and FSU has plenty of $$$ and is acting emotionally and illogically.
Notice how everyone else in the ACC has shut their mouths and refuse to put any money into backing FSU?
Don’t you know that rule #1 in the motivation behind almost everything single policy/action in the United States is FOLLOW THE MONEY!
They are staying silent while putting contingency plans in place…just in case.

They are letting FSU pay the ENTIRE bill fort he legal feesand IF there is a path to freedom it would have been due to FSU’s huge amount of resources and internal efforts.

AG Moody v ACC Writ of Mandamus case update #3 - the text of the readable agreements show / confirm that these agreements were designed to run until 2027. While there has been a lot of talk about an extension in the term of the agreement by letter, only one paragraph is amended. These contracts have multiple paragraphs that reference the various payout dates through a certain period. Any extension that was designed to extend the entire contract would have to restate ALL of these contract terms, not just the one paragraph. This lends credibility to the view that the current ESPN agreement with The ACC expires in 2027. A completely new Multi -Media Agreement, approved by the members according to the bylaws, would be required to extend the contract beyond 2027. Unless there is something else of consequence in the redacted portions, this tells me that the current agreement, and therefore the GoR, expires in 2027. According to 1.6.2 of the ACC Constitution, if 2/3 of the members vote to extend the Material Media Rights Agreement, that could bind Florida State and Clemson to the 2036 term of the GoR (if every other argument against the GoR fails). This is a reminder that for FSU and Clemson to win, they need to get a victory on just one of their arguments. For The ACC to win, they need to beat FSU and Clemson at every single argument.
The ACC Grant of Rights expires in 2036, but their media deal is only valid through 2027.
That being said, how any monetary penalties can be enforced if members of a conference are not being compensated is another topic.
If ESPN was so tempt to assist with keeping FSU/Clemson in the ACC, then they would have already agreed to extend the media rights to 2036.
In my opinion, I don’t think ESPN actually wants FSU (and Clemson to a lesser degree) to be in the ACC anymore. As much revenue FSU generates for pennies on the dollar, ESPN doesn’t want to continue paying for this entire conference. That’s the bottom line.
It would be in ESPN’s interest to have FSU (and Clemson to a lesser degree) join the SEC given it would allow for even better matchups while also keeping FSU in ESPN inventory.
The only other route for this to really be accomplished is if FSU joins the Big 12.
What is ESPN currently paying ACC members?
Before you compare the ACC to the Big 12 (because I know that’s what you will immediately respond with lol), you have to keep in mind that ESPN is the exclusive partner for the ACC, while ESPN & FOX are both partners with the Big 12.
From pure media revenue, ESPN is paying for the ACC’s media rights for about the same as what the Big 12 makes with ESPN & FOX, actually a little bit less. However, this does not include the ACC Network revenue distribution which obviously results in the ACC members making more than the Big 12.
Contrasting point #2 above, the only reason the ACC Network has any real material value is because of the 2 biggest revenue generators not just in the ACC, but all of college football, that being FSU & Clemson. If you remove FSU & Clemson from this formula, then the ACC Network isn’t really worth anything at all.
FSU & Clemson aren’t looking to just make more than the Big 12. They are looking to make close to, if not the same, as what SEC schools make. Based on current media revenue distribution, obviously the ACC nor Big 12 can really offer this.
Big 12 is willing to use Private Equity for what I assume is to not only pay for FSU/Clemson’s exit fees, but it would also temporarily bridge the revenue distribution gap until the next media deal negotiation
Just as ESPN doesn’t want to continue paying all this money to an unstable ACC, they would also never agree to exclusively partner with the Big 12 either.
No, I was going to do a ‘back of the envelope’ cost analysis of what it would cost ESPN to move pieces to the B1G, SEC, Big 12 and G5.
Let me se if I can find the numbers.
