Is FSU saying they do not intend to try and leave ACC until 2028?

As I’ve been saying all along…FSU is grasping at straws.

They’ve come at this from many angles and have found no path to get out.

If ESPN renews the contract in 2027, which they will, FSU has no path out.

Not exactly.

This bolsters the argument that there is NO guaranteed consideration in this contract beyond 2027.

And as we law geeks all learn in Week One of 1st year Contracts…no consideration…NO enforceable contract.

ESPN has whatever time to decide whether they wish to extend the contract. That decision will go a long way in deciding what happens with ACC…a failure to extend could actually force the league to disband and go somewhere that has a TV deal…but i cannot imagine that ESPN would do that…i think theyll extend it,but with a deal the way they want it, financially.

ESPN has the ACC at a discount.
The renewal OPTION is theirs.
Why wouldn’t they just renew?

FSU knows this and is trying to scream ‘bloody murder’ but they have no real authority to do so.

That’s why the August 15 deadline will come and go!

ESPN is 100% in control here. The instability FSU is trying to create is helping ESPN by giving them leverage to keep the conference undervalued or on par to what they are paying them now. FSU is pointing out the conference weaknesses and which helps ESPN!!

This is similar to a team option on a MLB player …ESPN is in full control of the extension option AT the same price!

EVERY ACC signed a GOR granting ESPN that option.

Except that according to FSU, they all signed it only because the ACC misrepresented to them that if they didn’t sign, then they’d never get another TV deal from ESPN again. That’s an almost certainly and demonstrably FALSE statement, given that every other conference (except the PAC, alas) was able to negotiate new and better TV deals with ESPN (see the Big 12 for more details).

That’s FRAUD Bro.

As I said, let the courts decide. And they aren’t likely to decide quickly.

Don’t assume that the ACC will win, don’t assume that a settlement won’t be reached, and don’t assume that either of those two schools will still be in the ACC beyond 2027.

They have a legal team and if they didn’t understand what they signed that’s on THEM!

WHEN they signed the deal, the ACC was the highest paid P5…they were ALL happy when they signed it PLUS they got their own network with revenue from that

No ACC fan thinks the ACC will blow up.

Again, i encourage you to go to their forums.

They may let FSU out eventually ( with a huge buyout fee) but that’s because they are a UT level pain in the arse…and they are better without them!

Hey, a lot of PAC fans thought they were staying together too, and that the Big 12 was an “unstable” conference.

How’d that work out? Where have we heard that before?

All it would take is an email or two to that effect and testimony in court from people in the negotiations to prove otherwise.

As I said, we’ll see what the courts say.

Those comparisons aren’t anywhere close.

The PAC had NO GOR, NO buyout fees and were landlocked to a region with declining football & basketball viewership with NO expsnsion opportunties (once they passed on killing the Big 12)

The ACC is the opposite and they expanded to PROTECT the conference from any departures

AND adding California and Texas RAISES the revenue generated by the ACC network.

SMU will get $20 million!!

I’ve been paying to attention what the courts have been saying…and FSU is grasping at straws!

And, at the same time, beached their fiduciary duty to look out for their members’ best interests by getting them a better TV deal.

The ACC looked out for its own interests (survival), over its members best financial interests by inviting valueless brands like SMU.

Another ground for a lawsuit.

I guess that’s why the ACC has lost pretty much every pre-trial motion and is now stuck possibly having a case tried in Florida where it wouldn’t be favorable.
