This is what happens when businesses cross over from employer to owner of personnel. Really surprised this doesn’t happen more often in the court

I understand the intent behind the practice and can see the benefits, but it’s wild to me that restaurants continue to do it when they should know better. I’ve seen other cases where the employees agreed to the practice before hiring on, and even those get dicey. But this is a huge payout - probably close to 10% of their annual sales.

I believe this is something pervasive in the industry that regularly goes unpunished. You have a small bar or restaurant where the owner only has that one place, people are more likely to quit than to try to take legal action.

Just because you can pay people less because they can make up for the minimum wage in tips, doesn’t mean you can use the tips to balance out the rest of your payroll.

The other thing restaurants do (though lots of businesses get in trouble for this) is not paying your payroll taxes. If you have a business not paying those, you’re out of business and you just don’t know it yet.

I sell HR and Payroll software. I had a call with a popular wing restaurant about 8 or 9 years ago. They classified folks as direct tipped (servers) and indirect tipped (bus boys, hosts, etc.). The tipped employees would tip out to the indirect folks. Then, in payroll, they would factor in the tips and adjust the hourly rates so the indirect people would get the same pay as they would without the tips. So in essence, they were stealing the tips from the bus boys and hosts.

They wouldn’t do this if it weren’t so ubiquitous industry-wide.
