The right to birthright citizenship was a 5-4 vote. The 6-3 vote was against the executive order to end the right citizenship because it violated the 14th amendment.
THAT is the key issue being litigated, and the key holding.
That means…only a Constitutional amendment can limit birthright citizenship, even for persons born to individuals who are unlawfully present.

I don’t necessarily agree with the concept of birthright citizenship in the modern world considering the ease of mobility of people into the US now (compared to 250 years ago) and the resulting ability to exploit this law for personal gain, however, there is no question in my mind that the Constitution allows it. It is kind of crazy to me that this wasn’t a 9-0 ruling - I mean it seems pretty much as clear as day what is in the Constitution. If a political party wants to change birthright citizenship they need to change the Constitution via amendment.
When you have a self-avowed “textualist and originalist” making the claim that the meaning of the Constitution has changed over the years because of immigration, you know all you need to know about his thought proce$$.
Not only is the text itself pretty clear, but we also have 130+ years of consistent precedent backing it up. Justices latching on to previously-rejected and constitutionally absurd arguments as justification for overturning precedent and ignoring the plain language is actually shameful.
Dumb ruling by the court. The 14th was never meant for those here illegally to get birthright citizenship. But that being said Congress should do their job and fix it. But they won’t because they never do the right thing
Probably won’t work. It would most likely require a Constitutional Amendment, and you need 2/3 of both houses, plus 3/4 of the states to make that happen.
The 14th amendment says what it says. Someone may not like what it says but that’s another issue.

Answer: at various times we had enough of a national consensus on a matter.
