Seen a couple of accounts from people outside of Coog Nation that claim NFL in fact called our legal team on Saturday morning before game time and said basically “cease n desist “ on production of any Columbia blue football jerseys.
Any of our B M A on here concur or know what really happened this summer with the alternative unis from last week!?
People all over the world begging for the merch and UH is awfully quiet!?! Huh!?
Did we cross the line and try and ask for forgiveness later? I heard Dana say thy we’re gonna rock them later in the season so maybe we got a license to wear but not produce.
It would be embarrassing for the Titans to issue a cease and desist on UH light blue uniforms. There is enough differences in the uniforms to not be a trademark infringement.
We need some enterprising young students to go full Napster on the UH Columbia blue jerseys and start selling them to all the students and alumni that want it.
I heard John McLain on AM 610 say that someone in the Adam’s family made an inquiry and statement about stopping UH from using the colors, but nothing was actually done.
The Titans have something like a copyright / trademark for “Columbia Blue” but there has to be more connections than just that. We didn’t use Columbia Blue. Columbia Blue is a lighter blue than the UH jerseys used.
Yes, because as I posted before, cases like Jacobson have established that color alone can be an enforceable trademark if it has taken on secondary meaning in the marketplace, and there is a risk of confusion.
Is it possible that a consumer that saw that jersey would confuse it for an Oilers jersey?
If so, then any lawsuit of that sort wouldn’t be baseless, though in this case, it’d be a real dikk move.
The Oilers fan shooting the bird into the camera on live telly led to one of the most famous ad libs in history. After the fan shot the bird, Don Meredith said: “He thinks his team is #1.”
