NFL orders cease and desist for Oilers colors

Again, trademarks don’t have to be exactly alike, only substantially similar.

Enough to create a risk of confusion.

Each federal circuit has its own multi-factored test for confusion.

UH will most likely need a license and will very likely have to pay a royalty, if the Titans even allow this at all.

The probability of winning a lawsuit like this for UH is probably not high enough to justify the costs of litigation.

You folks have just listed reasons nr. 325 to 387 why I TURN OFF NFL games when they show up on my television screen. The Adams family (and the others just like them) are greedy sob’s who sit up on their well fed asses making fortunes because American men (primarily) are too damn lazy to go outside on a Sunday afternoon or Monday evening and find something useful to do with their time (like enjoying their neighbors or their kids, or their damn dogs).

While I can see why former Houston Oilers players feel connected to the Titans franchise, it’s far more difficult to understand why the Houston Oilers, or their colors, would matter to the people of Nashville or Tennessee.

Even J.J. Watt, who represented Houston and the Texans, wanted to wear the “Luv Ya Blue” uniforms:

“Having lived in Houston for 10 years and the people there and the connection that they have to Earl Campbell, to Warren Moon, to these guys that wore those,” Watt said on Wednesday’s edition of The Pat McAfee Show . “These guys that wore those uniforms and what that meant when they played at the Astrodome. It hurts to not have been able to wear those in Houston and it hurts to see them being worn somewhere else.”

Houston is emotionally connected to the “Luv Ya Blue” colors; Nashville is not. While I wish the Titans the best, the Houston Oilers are a part of Houston history, not Tennessee’s or Nashville’s.

It’s time to give back to Houston what it’s due, Titans.

For us who grew up with the Houston Oilers, lived and died with every loss, and have the emotional scars to show for it, it has hard to convey the deep connection a professional sports franchise has on its fans. By the time they moved to Tennessee, there was so much anger at the owner for “playing” Houston into getting a new stadium, it was goodbye, good riddance.

All the fans’ emotions came back and hit an apex when the early Tennessee Titans uniforms resembled the Houston Oilers. For me, it was a punch in the gut.

I’ve resigned to the fact that it was a great chapter in Houston sports history that will never be repeated. There is no reason whatsoever that new memories can’t be created by the Houston Texans.

There’s zero chance the Adams family will license those uniforms to anyone in Houston. Just personal pettiness.

Please cease and desist from wearing Oilers throwback uniforms. You are not worthy of them. We citizens of the Greater Houston area are sickened by your attempts to cover yourself in the glory of past Houston nostalgia.

I’m in the construction equipment business. Recently a sales rep for a Chinese company stopped by asking if we would be interested in buying some of their machines. I wasn’t interested, but talked to the guy for a few minutes. He told me they have to start painting their machines a different color due to a lawsuit from another manufacturer. They basically copied their machine, aside from a few small differences, and painted it the same color.
