You can be held without bail prior to your trial date and still presumed innocent… try again.

The part that fails is you can’t get the right to a speedy trial anymore because courts are bogged down prosecuting a bunch of BS…

But you can’t be held without bail simply because of the type of charges.

What stuff are you referring to exactly bogging
the criminal courts down ?

You can be presumed a flight risk due to the charges you face…

But a presumption isn’t enough to issue a blanket decree that people charged with certain crimes aren’t entitled to bail. And every presumption is rebuttable.

No bail will always be the exception for every crime, with the limited exception of capital offenses and a few others (repeat felonies, felony while on bail, etc.)

Can y’all show me where in the constitution it says you’re entitled to bail or the supreme court ruling that sets precedent that you are entitled to bail before your trial…?

From what I can tell it’s the us constitution 8th amendment that mandates no excessive bail shall be set… so… I stand corrected.

It also says no excessive fine shall be imposedbut I know courts break that… I can think of one case recently in NYC that had an extremely excessive fine…

Judges will sometimes revoke a person’s bond/bail IF they violate the conditions of their initial bail/bond.

Anything ā€œexcessiveā€ is up to the court’s discretion and up for appeal (and the case you’re discussing is going through that currently). When there is a lot of precedence on something (like bail), I’d guess it’s a lot easier to gauge that mark.

I’m sure there have been plenty of cases of excessive bail being overturned too.

I don’t know I’d call that BS. I’d have to defer to legal experts here what
is ā€œbogging downā€ the criminal court system and how long it takes to prepare
a capital case. I’m sure getting a court date set is one piece of it, but it probably
takes time to do investigations and defense needs time to prepare for a case too.

About how often does that happen generally speaking ? 1%, 10%, …or less then 1% of the time.

It’s fairly common.

A person might be arrested for dope, post a bond, and then, only weeks later while out of jail, get picked up for domestic violence, shoplifting, etc and get their bond revoked.
